Agreement to Terms

By accessing or using Stranded ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you do not have permission to access the Service.

Description of Service

Stranded provides emergency access to your contacts, notes, and documents through a web portal and mobile application. The Service allows you to sync your information to the cloud and access it from any device using your username and PIN.

User Accounts

Account Creation

To use the Service, you must:

  • Be at least 13 years of age
  • Provide accurate and complete information
  • Choose a unique username
  • Create a secure PIN (4-6 digits)
  • Maintain the security of your account credentials

Account Responsibility

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to other users' accounts
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated tools to access the Service without permission
  • Impersonate any person or entity
  • Harass, abuse, or harm another person
  • Collect or store personal data about other users

Content and Data

Your Content

You retain all rights to the content you upload (contacts, notes, documents). By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

Content Restrictions

You agree not to upload content that:

  • Infringes on intellectual property rights
  • Contains illegal material
  • Is defamatory, obscene, or offensive
  • Violates any laws or regulations

Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify or discontinue the Service at any time with or without notice.

Data Backup and Loss

While we implement robust backup systems, you are responsible for maintaining your own backups of important data. We are not liable for any data loss that may occur through use of the Service, including but not limited to deletion, corruption, or failure to store data.

Privacy and Security

Your use of the Service is also governed by our Privacy Policy. We implement security measures to protect your data, but no method of transmission over the Internet is 100% secure. You use the Service at your own risk.

Intellectual Property

The Service and its original content, features, and functionality are owned by Stranded and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through the app settings.

Limitation of Liability

To the maximum extent permitted by law, Stranded and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use or inability to use the Service.

Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Indemnification

You agree to indemnify and hold harmless Stranded and its affiliates from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
